Thomas Cook goes bust – Can I still make an EU261 claim?

Thomas Cook Group including the Tour Operator and the Airline ceased trading on Monday 23rd September 2019 after failing to secure another £200,000,000 which its creditors believed was required to continue in the short term.

The Group consists of:

  • Thomas Cook Retail Limited
  • Thomas Cook Tour Operators
  • Future Travel Limited t/as Freedom Personal Travel Advisors
  • TCCT Retail Limited Thomas Cook has worldwide operations with 21,000 staff 9,000 being in the UK.
  • Fleet – Airbus and Boeing total 117

How am I effected:

Customers already abroad

The Government and the CAA are now working together to repatriate customers currently aboard that is roughly 150,000. This operation will take place between 23rd September and 6th October 2019. This operation covers nearly all locations. The operation ceases on 6th October when it is expected that nearly all customers will have been repatriated. The fleet was grounded so that new passengers would not be added. It was also essential that the fleet be grounded in the UK to prevent the asset being seized against repayment of debt.

Customers who have not yet taken their holiday (from a UK airport).

Regrettably your holiday and flight has been cancelled. However, you can claim back the cost via ATOL (the travel industry compensation Scheme).

Customers on Flights only

All flights have been cancelled. Flights only are not covered by ATOL but if you used a credit card to purchase the tickets and spent over £100 then you may claim the money back from the credit card company. The claim should be made under Section 75 of the Consumer Credit Act.

Customers of Tui and First Choice with flights by Thomas Cook

Tui Europes biggest Tour operator has cancelled thousands of holidays due to fly with Thomas Cook Airline as part of a package, up to the end of October 2019. Tui are working to find alternatives. It is likely that all flights with Thomas Cook Airlines will need to be replaced by Tui (Tour Operators ) and First Choice.

Customers booked to Fly with Condor

Condor is registered in Germany . Thomas Cook has a 49% shareholding. The company has requested emergency funding from the German Government (Eur 200m) to assist following the demise of Thomas Cook. Condor has issued a statement to say it will not carry passengers booked through Thomas Cook . The Airline has requested customers to contact their Travel Agent where compulsory insurance will cover the loss and passengers will be reimbursed.

EU261/2004 claims

What will happen to my claim? If your claim is agreed, then you will become an unsecured creditor and may eventually be paid part of your claim by the administrator. If your claim has not already been assessed if may too late. It is unlikely it will now be assessed and so will be an unproven claim. In order to ensure your claim is a valid claim it is likely that it will be necessary to litigate. However, the costs outweigh the possible benefits so in practice your claim will not progress.
